Legal outsourcing

One of the leading areas of our Legal Counsel's Office activities is legal servicing of any organizations, as well as individual entrepreneurs on the contract basis (so-called judicial outsourcing [1]).

Global practice has proved that judicial outsourcing is one of the most successful business-models because with its application dependence from objective and non-objective reasons of ceasing or terminating of business-processes is almost eliminated.

Furthermore, judicial outsourcing is a useful and rather efficient instrument for customer’s costs decreasing obtaining in return high quality legal services.

What is attractive in servicing of organization/individual entrepreneur based on the contract with the legal counsel?

Legal counsel is a highly competent expert in judicial field that has obtained the status of a legal counsel after having passed special examination, required by lawyer legislation, and passing the selection by Lawyer Chamber committee.

In accordance to the Federal Law №63-ФЗ dated 05/31/2002 «Concerning the activity of legal counsels and advocateship at the territory of Russian Federation» advocateship acts at the basis of legality, independence and self-governing principles. Every legal counsel shall be obliged to protect the interests of his customer in an honest, rational and proper way, permanently improving his knowledge and qualification, to comply with professional ethic code and lawyer’s secret. The legal counsel cannot be called and interrogated as a witness of circumstances, acknowledged by him in relation with seeking of his professional assistance or in connection with provision of such assistance.

Legal counsel is permanently carrying out legal practice in his routine activity, since he is acting as an attorney of his constituent in judicial proceedings and other conflict resolving authorities, as well as represents and protects his constituent’s interests in the state and local authorities, public and other organizations.

Inestimable versatile practical experience of a legal counsel allows him to predict probable weaknesses in legal defence of the organizations and to perform efficient quick actions in order to avoid irreversible negative consequences for the customer.

What are the benefits of judicial outsourcing comparing to employment of required staff?

  • Hiring a legal counsel as a outsource expert provides additional confidentiality warranties concerning all facts about organization’s/entrepreneur’s activities, because this information will relate to legal counsel’s secret protected by law. Unlike any other expert, legal counsel does not have to provide such information even on request of a law-enforcement agency. Thus, the problem of unwanted outflow of Customer’s information is being solved;
  • While using outsourcing principles in business relations the labour legislation is not applied. As a result, the organization/individual avoids employment human resources personnel, as well as complying labour legislation in general (in particular, social money transfers to special funds, providing the employees with various social guarantees, workplace organization and other legal obligations regulated by Labour Code of the Russian Federation won’t arise). In such circumstances Customer’s financial costs decrease significantly;
  • The capability to refer the amounts of money under the servicing contract to outcomes in order to decrease taxation base for corporate income tax purposes or at using simplified taxation scheme arises, which is exactly a legal way of tax optimization;
  • All our Legal Counsel’s office, including the legal counsel herself and her assistants having high legal education and specializing in different branches of law, works under the single contract of legal servicing;
  • Flexibility of contract terms. List of services and payment procedure, optimal for the Customer, are chosen.
